Judge Dismisses Trump’s Florida Case

In Florida, a judge has dismissed the case against former President Trump regarding his handling of classified documents.

Trump had been charged as a result of special counsel Jack Smith’s investigation into the possession of classified materials at Trump’s Mar-a-Lago residence. He pleaded not guilty to 37 felony counts, including willful retention of national defense information, conspiracy to obstruct justice, and false statements from Smith’s probe.

U.S. District Judge Aileen Cannon granted Trump’s Motion to Dismiss Indictment based on the unlawful appointment and funding of Special Counsel Jack Smith. The ruling stated that the Superseding Indictment was dismissed due to the violation of the Appointments Clause of the United States Constitution.

Following the ruling, Trump expressed his satisfaction to Fox News’ Bret Baier, stating the judge’s decision was courageous and wise. He emphasized the significance of the ruling not only for his case but for others as well.

The Appointments Clause stipulates that certain officers should be appointed by the President with Senate consent, which was not the case for Smith, who was never confirmed by the Senate.

The judge highlighted the breach of constitutional structures by Special Counsel Smith’s prosecution, emphasizing Congress’s role in appointing officers and authorizing expenditures by law.

Trump had previously requested a pause in the case after a U.S. Supreme Court decision granted presidents substantial immunity for official acts during their term. Trump’s lawyers asked for a pause in proceedings until the judge could apply the Supreme Court’s immunity ruling to the case. Smith has the option to appeal Monday’s ruling.
