Boston Federal Judge Blocks Trump Mail-in Voting Executive Order

The Obama nominee judge sided with various Democratic-led states that contend the Republican president is trying to meddle illegally with the states’ administration of federal elections.

A federal judge in Boston obstructed President Donald Trump’s executive order stiffening rules ‌for mail-in voting, a crucial setback to the president’s election law agenda ahead of November elections that will determine control of Congress.

According to a story by Newsmax, U.S. District Judge Indira Talwani, a nominee of Democratic President Barack Obama, sided with various Democratic-led states that contended the Republican president is trying to meddle illegally with the states’ administration of federal elections.

On March 31 Trump signed the order after four years of demanding for tighter rules on voting by mail and claiming that his 2020 ⁠election defeat was the consequence of pervasive voter fraud.

Under the U.S. Constitution, states ​are assigned the role of administering federal elections.

Instead, Trump’s order directs the U.S. Department ⁠of Homeland Security to compile and convey to the states a list of verified U.S. citizens eligible to vote in each state, derived from citizenship and naturalization records and other federal databases.

In addition, the Trump order also compels the U.S. Postal Service to only deliver ballots to voters ​on each state’s approved ‌mail-in ballot list. Recently, the USPS implemented Trump’s directive by sending new proposed rules requiring states to provide ‌the names and barcodes tied to their mail-in ballots.

Trump’s order also instructs the U.S. Department of Justice to give priority to the probe and prosecution of state and ⁠local election officials who send federal ballots ‌to people deemed “not eligible” ⁠to vote.

But voting rights groups sued the administration along with 23 states and the District of Columbia, contending that ⁠Trump’s ⁠order is unconstitutional and that Trump does not have any legal authority to assert presidential power over election administration.
