Records Show Planned Parenthood Gave State AGs 14-Point Plan to Dismantle Pro-Life Laws & Harass Pregnancy Centers

Less than a month after Roe v. Wade was overturned by the US Supreme Court in the 2022 Dobbs decision, Planned Parenthood issued a memo to Democrat state attorneys generals containing a 14-point plan to dismantle pro-life policies and harass pro-life pregnancy centers, according to the Daily Signal.

The memo was especially meant for attorneys generals in “Access States,” the states in which abortion laws were already strong and were likely to draw out-of-state abortion seekers.

The memo included the following points:

  1. Encouraged the issuance of statements “affirming commitment to protecting abortion access”
  2. Direct state funding towards abortion providers
  3. Support funding for security for abortion centers
  4. Work with law enforcement to provide training on existing laws regarding clinic access, including the FACE Act
  5. Clarify legal ambiguities. “Even in states that have repealed the vast majority of restrictions, there may be questions about how the Supreme Court decision will impact a state’s laws,” the directive read. “For example, states that do not have a law governing a minor’s right to consent to an abortion could issue guidance explicitly asserting consent to abortion rights for minors.”
  6. Issue “shield laws” to protect abortion providers from extradition to other states for violating those state laws
  7. Carefully consider whether the pursuit of constitutional amendments is the most financially expedient, or whether constitutional amendments “could be part of a broader framework that would encompass other important rights and potentially appeal to more constituents, such as freedom from sex discrimination.”
  8. Take steps to “curb” the “misleading and deceptive practices” of crisis pregnancy centers (CPCs)
  9. Pledge non-prosecution of women who obtain abortions
  10. Coordinate a network of law firms to provide pro bono legal representation to individuals and abortion providers
  11. “Investigate and address data privacy concerns as they relate to the provision of reproductive health care” – limit state collection of certain data, issue AG statement regarding interpretation of current laws as it pertains to abortion data
  12. Support pro-abortion legislation
  13. Support repeal of pro-life laws
  14. “Reiterate our federal asks” with the Biden-Harris administration, like asking for the declaration of a “public health emergency;” support federal access to abortion in ways including “transportation, hotels, time off work, child care, and other needs” for out-of-state abortion travelers;” “Launch a public education campaign about the safety and accessibility of medication abortion,” the memo stated. “The Federal Trade Commission (FTC) should also target misinformation perpetuated by crisis pregnancy centers regarding medication abortion.”

In the months that followed the issuance of this memo, several Democrat state attorneys general appeared to make moves following this general blueprint:

  • July 2022:  New Jersey AG Matthew Platkin issued guidance for state prosecutors in enforcing abortion clinic access laws
  • August 2022: Minnesota AG Keith Ellison issued a “consumer alert” about CPCs
  • December 2022: New Jersey AG Matthew Platkin issued a similar consumer alert and subpoenaed a CPC, First Choice, for their donor information
  • September 2023: California AG Rob Bonta sues several CPCs
  • Several state AGs issued statements regarding abortion medication

Earlier this month, Catholics for Catholics reported on statements from current US Attorney General Todd Blanche indicating that the Trump administration is working to “get permanent solutions so that the Dobbs decision becomes permanent in every state,” specifically mentioning the issue of mail-order abortion pills going to states that have banned this form of abortion.
