A split Supreme Court permitted the Trump administration on Monday to proceed with policies to curb mail-in voting prior to the midterm elections.
In an emergency opinion, the judges said President Donald Trump could carry on with effecting an executive order he had signed, which commanded the U.S. Postal Service to help decide which voters should receive mail-in ballots. Under Trump’s order, the Department of Homeland Security will also form lists of U.S. citizens that the administration believes could be used to monitor voter rolls for noncitizens.
Still, according to a story by Forbes, Democrat-led states vowed they will keep fighting the Trump administration’s attempts to limit the use of mail-in voting ahead of November’s midterms, after the Supreme Court, in an emergency ruling, lifted a lower court injunction blocking the efforts without weighing in on their legality.
New York Attorney General Letitia James said the court’s decision was a “painful setback” but not the “final word,” and added that the “fight is far from over,” and the state was exploring legal options.
Kris Mayes, Arizona’s Attorney General described the ruling as “procedural” in an X post and echoed comments made by other AGs saying states run their elections: “Not the Postal Service. Not the President.”
In a post on X, California Gov. Gavin Newsom, who has been lauded as a possible presidential candidate during the 2028 elections, blasted the ruling: “The Supreme Court just let the Trump Admin move ahead (for now) with its plan to disenfranchise voters across the country. California will be suing AGAIN to block these Orwellian rules from being implemented.”
According to Forbes, in the 6-3 ruling, the Supreme Court’s conservative majority conceded the Trump administration’s appeal against a lower court injunction that had blocked federal agencies like the U.S. Postal Service and the Department of Homeland Security from enforcing parts of Trump’s executive order from March.
