The State of California is declining to terminate policies that permit male students who identify as females to take part in school sports in harmony with their gender identities.
According to The Epoch Times, Golden State education officials are rejecting the U.S. Department of Education’s Office for Civil Rights (OCR) to terminate policies that allow transgender students to participate in girls’ sports.
The California Department of Education (CDE) informed OCR that it “respectfully disagrees with OCR’s analysis” and will not sign a propositioned resolution agreement containing student athletic participation. General Counsel Len Garfinkel penned the letter as a response to a previous letter sent by federal officials.
OCR determined in a June 25 declaration that California’s sports policy discriminates against female athletes by allowing males to take part in girls’ sports and by using female restrooms and locker rooms.
The federal agency suggested that California implement biology-based definitions when it comes to sex, and to restore female athletes with titles and records that they lost when they competed with transgender participants who identified as female.
“Although Governor Gavin Newsom admitted months ago it was ‘deeply unfair’ to allow men to compete in women’s sports, both the California Department of Education and the California Interscholastic Federation continued as recently as a few weeks ago to allow men to steal female athletes’ well-deserved accolades and to subject them to the indignity of unfair and unsafe competitions,” U.S. Secretary of Education Linda McMahon said at the time, referring to comments Newsom made on a podcast earlier this year.
The Times reported that the June 25 statement also noted that OCR had opened separate investigations into both the California Department of Education and the California Interscholastic Federation, and warned that failure to comply could result in enforcement action from the Department of Justice.
