The lawsuit says Trump’s efforts to federalize DC are illegal, and are asking a federal judge, a Biden-era appointee, to overturn the executive order.

After a court hearing on Friday, the Trump administration agreed to change course and permit the Washington, D.C. police chief to remain in charge of the department.

Via a new memo, Attorney General Pam Bondi instructed the District’s police to cooperate with federal immigration enforcement “notwithstanding” city law.

According to Fox News, the lawsuit, which was filed Friday by D.C. Attorney General Brian Schwalb, defied Trump’s executive order to provisionally federalize D.C. under Section 740 of the D.C. Home Rule Act.

In addition, the lawsuit challenged Attorney General Pam Bondi’s more recent order that seeks to establish the DEA head as the emergency commissioner of the Metropolitan Police Force — contending the moves are unparalleled, “brazenly unlawful,” and could “wreak operational havoc” on the Metropolitan Police Department.

Schwalb pleaded the court to block both of the administration’s orders, saying that the Trump administration’s temporary takeover of D.C. police under Section 740 of the D.C. Home Rule Act “does not authorize this brazen usurpation of the District’s authority over its own government.”

“They infringe on the District’s right to self-governance and put the safety of DC residents and visitors at risk.” Schwalb said.

Schwalb moreover petitioned the court to concede emergency relief by granting a temporary restraining order, or TRO, that would impede Trump’s order from taking force instantly while the court considers the merits of the case.

U.S. District Judge Ana Reyes, a Biden appointee, was selected as the judge of the case.

Fox News reported that the position will probably put Reyes, who also presided over a lawsuit involving Trump’s ban on transgender service members, back in the president’s crosshairs for the second time in less than eight months.
