U.S. Supreme Court to Consider Overturning Landmark “Same-Sex Marriage” Decision

The U.S. Supreme Court has been formally asked to reconsider its 2015 Obergefell v. Hodges decision which legally recognized same sex ‘marriage’ nationwide during the Obama administration.

The request comes from Kim Davis, a former Kentucky county clerk jailed in 2015 for refusing to issue marriage licenses to same-sex couples due to her religious beliefs. Davis is appealing a $100,000 jury verdict for emotional damages and $260,000 in attorneys’ fees, arguing that her First Amendment rights protect her from liability and that Obergefell was wrongly decided.

Her petition claims the ruling was based on flawed legal reasoning and should be overturned, similar to the 2022 reversal of Roe v. Wade. This marks the first significant challenge to Obergefell since 2015, though some ‘legal experts’ consider her case a long shot, as lower courts have rejected her claims, stating the First Amendment does not protect state actions. The Supreme Court will decide this fall whether to take up the case, with potential arguments next spring and a ruling by June 2026.

“Same-Sex ‘marriage’ will eventually fail”

The United States Conference of Catholic Bishops (USCCB) hasn’t yet published a statement regarding this recent news. However, back in June 2015, they said that regardless of what a narrow majority of the Supreme Court may declare at that moment in history, the nature of the human person and marriage remains unchanged and unchangeable. ‘Obergefell v. Hodges does not settle the question of marriage today… This decision, just like Roe v. Wade, hasn’t been rooted in the truth, and as a result, it will eventually fail,’ said the American bishops.

“It is profoundly immoral and unjust for the government to declare that two people of the same sex can constitute a marriage. The unique meaning of marriage as the union of one man and one woman is inscribed in our bodies as male and female.” they added.

Even thou the Republican party softened its stance on natural marriage, vowing to ‘empower all American families’ on their 2024 platform, conservative support to same sex unions continue to decline nationwide. As a matter of fact, Republican’s support dropped 14 points since 2022, according to a 2025 Gallop Poll:

“Democrats’ support has risen to 88%, the record high for this group by one percentage point. Republicans’ support, which peaked at 55% in 2021 and 2022, has gradually edged down to 41%, the lowest point since 2016 after the Obergefell decision.”

For more than 2,000 years, the Catholic Church continues to hold that marriage is, and can only ever be, the union of one man and one woman: a conjugal (total) union that is ordered toward the good of the spouses and the procreation and education of children.

“Marriage is the measure of true love between a man and a woman”

Pope Leo emphasized this unchangeable teaching in his homily during the Jubilee for Families on June – that marriage represents “not an ideal but the measure of true love between a man and a woman: a love that is total, faithful, and fruitful.” He cited Pope Paul VI’s 1968 encyclical Humanae Vitae, noting that conjugal love “makes you one flesh and enables you, in the image of God, to bestow the gift of life.”
