RFK Jr.’s Children’s Health Defense Sounded Alarm on Section 453 of Spending Bill
Children’s Health Defense (CHD), the organization founded by Robert F. Kennedy, Jr., among other activists, sounded the alarm on a provision of the appropriations bill for fiscal year 2026. Section 453, according to CHD, had the intention to “wipe out your right to sue pesticide companies” and “blocks updated health warnings and gives chemical manufacturers immunity even when people are harmed.”
The provision of the appropriations bill covered more than 57,000 different chemical products with links to cancer, infertility, Parkinson’s, and more.
🚨URGENT: Congress is about to wipe out your right to sue pesticide companies, quietly, tucked in a new spending bill.

Conservative podcaster and influencer Brett Cooper joined Fox News and directed her criticisms directly at the GOP. “House Republicans are slipping something into our new spending bill which would give immunity to huge pesticide companies,” she warned. Cooper says Republicans are “giving the middle finger” to the MAHA (Make America Health Again) movement.

Supporters of Section 453, according to the CHD, said the provision merely prevents a patchwork of labels – i.e., would prevent individual states from mandating labels for a product that differs from the federal label required. “That’s false,” the CHD writes. “Federal law already preempts state labels. Section 453 doesn’t clarify law, instead it removes accountability. This is misinformation pushed by chemical interests.”
“Who benefits? Chemical manufacturers facing massive liability for cancer, neurological disease, and infertility. Who loses? Families. Farmers. Workers. Children.”
The nonprofit Stand For Health Freedom further explains the implications that “[e]ven if manufacturers want to add health or safety warnings, Section 453 prohibits EPA from approving them if they conflict with an outdated health assessment. This strips companies of the ability to inform users—even when they know the risks.”
Health coalitions are urged citizens to contact their senators and ask them to remove Section 453 before it hits the Senate floor next week.
Later today, Monday January 5th, MAHA Action (Make America Healthy Again) shared an important update on X regarding this dangerous initiative, stating that section 453 granting pesticide companies immunity from harm has been removed from the upcoming House spending bill.
“The Senate version of the bill also does NOT contain Section 453. Once again MAHA has proven just how powerful our voice is when we come together on an issue” they added.

Representative Thomas Massie also celebrated the victory and advised the citizens to consider the new legislature on the bill while continue fighting to Make America Healthy Again.
Great news! This bill has been consolidated with two other appropriations bills and SECTION 453 HAS BEEN REMOVED due to public feedback. The new bill doesn’t have an HR # yet, but the text of the new legislation to be considered can be found here: https://t.co/mijP6wE2oO https://t.co/XQ9dWECCI2
